Freedom of Information Request (no 3, 20 April): complete correspondence, including College Response (late, 6 June)

This post is made on a personal basis, as a member - and until 4 February 2017 Chairman -of SWYM because of my significant concerns about the running of the musically excellent Wessex Youth Orchestra, and about recent aspects of the governance of SWYM and the management of the CWYM and College. Yesterday 6 June I finally received (the main part, but not all, in particular no information about which schools the schedule was sent to, presumably none) a response to my Freedom of Information request of 20 April, which was due under the Act by 23 May at the latest. (Previous posts referring to this particular request are here and here, but I have put the entire email chain below for ease of reference, with most recent emails at the top).

Please find attached a copy of the Wessex Youth Orchestra Rehearsal Schedule Summer 2017.  Please note the rehearsal on 24th June is no longer red.  This is because some of the students are taking part in the Duke of Edinburgh scheme and also university open days, etc.

Your response please?  Given the formal complaints that are currently being investigated I need to have confidence that the College’s responses are accurate and your reply that there is no schedule this term looks odd given your use of the plural “schedules” and the recent statement  in the WYO Key Facts document that schedules are sent out a few weeks before the start of term.

Dear Mr Roberts

Thank you for your reply.  So in your reply earlier today when you stated “the rehearsal schedules for 2017 were sent to you”, you meant that there was only one schedule (for Spring) despite your use of the plural, “schedules”?  

Also, the “Centre for Wessex Young Musicians – Key Facts” recently sent to schools includes (see https://photos.smugmug.com/MusicMattersAndCulture/i-hvJt5d9/0/409710ba/O/WYODocumentReCooperation%26Collaboration2017Page1.jpg) “WYO schedules are released to members no later than 4-6 weeks in advance of the start of each new term”.   
Please will you confirm that despite this very recent claim by the WYO, the WYO has in fact stopped sending schedules (similar to those sent during at least the last 3 terms, and the most recent of which can be seen at https://musicmattersandculture.blogspot.co.uk/2017/04/secret-wyo-rehearsal-schedules-which.html) to its members?

I have just double checked, and your response to my previous request F0083 only included the WYO schedule for Spring 2017 (January to March, in a document entitled “WYO Rehearsal Schedule  Spring 2017 - advanced notice copy.pdf”), and not that for Summer 2017.  It only contained one rehearsal schedule, and not “the Wessex Youth Orchestra schedules for 2017”, which implies schedules for all 3 terms.

Please will you supply the schedule for Summer 2017 and associated information as per my request F0086, without any further delay?

As the Centre for Wessex Young Musicians website still implies (at http://www.cwym-music.com/wyo-membership-guidelines.html) that the Wessex Youth Orchestra rehearsal schedule is confidential to WYO players and their families, in contravention of Jacqui Kitcher (WYO Director Susanna Riddell’s line manager)’s statement to the SWYM Committee last December that she expected the schedules to be published, please would you send me (in electronic form):

1.       A copy of the WYO rehearsal schedule for this term (summer 2017), together with a copy of any associated instructions, and a list of which other organisations (and the roles of the people at those organisations, e.g. head of music at a school) the schedule has been sent to. 
2.       In what proportion of Freedom of Information Act responses does the Bournemouth & Poole College claim (as it did in the responses to my two previous requests, contrary to ICO guidance at https://ico.org.uk/media/for-organisations/documents/1150/intellectual_property_rights_and_disclosures_under_the_foia.pdf) that copyright would be infringed by publication of the responses?

As before, please would you acknowledge receipt of this request? Thank you.
